Scope of these terms

These terms address access to Coincident’s public website and its informational content. By using the website, you agree to these terms to the extent an enforceable agreement is formed under applicable law. If you do not agree, please stop using the website.

Paid services, trials, client workspace access, deliverables, confidentiality, fees, data-processing instructions, and service commitments are governed by the separate agreement for your organization. These website terms do not replace or amend that agreement. An invitation or a website demonstration is not a commitment to provide a particular capability.

Access & authorized use

Use the website lawfully and only on your own behalf or with authority to act for your organization. Workspace access is by invitation and subject to the permissions granted to you. Do not share sign-in codes, use another person’s account, or access material outside your authorization.

We may restrict access when reasonably necessary to protect the service, investigate misuse, or comply with law. Any suspension of contracted services remains subject to the applicable customer agreement.

Research, forecasts & simulations

Coincident’s systems support analysis and human judgment. Generated research, scenarios, synthetic responses, and forecasts may be incomplete, inaccurate, biased, or sensitive to the inputs and assumptions used. A modeled population is not a panel of interviewed people; a generated response is not a real person’s statement.

Unless expressly identified as observed and verified, website demonstrations and example profiles are illustrative. Do not present a simulation as a measured poll, verified fact, testimony, or guaranteed outcome. Review original sources, methodology, assumptions, and uncertainty before relying on or publishing results.

Website content is not legal, financial, medical, or other regulated professional advice. It does not establish a fiduciary relationship. Responsibility for decisions remains with the people and organizations making them.

Intellectual property

Coincident and its licensors retain their rights in the website, software, visual identity, and original content. You may view the public website and share links for lawful purposes. This does not grant a right to resell the service, impersonate Coincident, remove ownership notices, or reproduce protected materials beyond permission granted by us or applicable law.

You retain any rights you hold in material you submit. You must have the permissions needed for us to handle it for the requested purpose. Rights in customer inputs, deliverables, and licensed source material are governed by the customer agreement and applicable third-party rights; use of the website does not transfer them.

Acceptable use

Do not interfere with the website, introduce malicious code, bypass access controls, extract nonpublic information, infringe others’ rights, or use the service for unlawful or deceptive conduct. The Acceptable Use Policy describes the standards for authorized use of our research and simulation services where incorporated into an engagement.

Do not submit passwords, classified information, or regulated or highly sensitive personal information through the public contact form. Arrange an appropriate channel and agreement with us first.

Third-party material

Research sources and linked services remain the responsibility of their respective publishers. A link or citation does not imply endorsement, ownership, accuracy, or permission to reuse the source. Check the applicable source terms and permissions before redistributing material.

Availability & warranties

To the extent permitted by law, the public website and its informational content are provided as available, without warranties of accuracy, completeness, uninterrupted operation, merchantability, fitness for a particular purpose, or non-infringement. We may revise or discontinue public website features. Express commitments in a signed customer agreement are unaffected.

Limits of responsibility

To the extent permitted by applicable law, Coincident is not responsible for indirect or consequential losses arising from use of the public website, including lost profits, lost opportunities, or decisions based on illustrative content. Nothing in these terms excludes liability that cannot lawfully be excluded, including any non-waivable consumer rights. Liability for contracted services is determined by the applicable customer agreement.

Changes & other agreements

Revised terms will be posted with an updated date. Material changes will receive any additional notice required by law and will not retroactively change a signed engagement. If part of these terms is unenforceable, the remainder continues to the extent permitted by law. A failure to enforce a provision on one occasion is not a waiver of future enforcement.

These terms do not impose mandatory arbitration or a class-action waiver. Any governing-law or forum provision for a customer engagement belongs in that agreement and remains subject to mandatory legal protections.
